When his father's estate was probated on 7 Dec 1702 in Watertown, guardian bond was posted by Isaac Beach of Newton, husbandman, with Joseph Whitney and John Whitney of Watertown as sureties, as guardian of Benjamin Whitney aged 17 years and up, son of Joseph Whitney, late of Watertown, decd., he had chosen his uncle Isaac Beach as guardian.

His estate was probated 19 Oct 1736, Watertown, Middlesex, MA; will of Benjamin Whitney late of Watertown lodged; Joseph Whitney cited the widow and all heirs; est/pro 8 Nov 1736 Wat/Mid/MA; executor's bond posted by Joseph Whitney, with John Whitney and John Tayntor, sureties, all of Watertown.
